1. Introduction

Welcome to TurkCoach ("Company", "we", "our", "us"). These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at turkcoach.com (the "Service") operated by TurkCoach.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Coaching Services

TurkCoach provides professional business coaching services aimed at helping businesses scale and grow. Our services include but are not limited to business strategy development, leadership coaching, operational improvements, and market expansion guidance.

All coaching services are provided on an "as is" basis. While we strive to deliver high-quality services that achieve results, we cannot guarantee specific outcomes as business success depends on many factors, including client implementation of strategies.

3. Service Agreements

Coaching engagements are formalized through separate service agreements that outline specific deliverables, timelines, fees, and terms. These service agreements work in conjunction with these Terms of Service.

Any modifications to a coaching engagement must be agreed upon in writing by both parties. Verbal agreements are not recognized as valid modifications to any service agreement.

4. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of TurkCoach and its licensors. The Service is protected by copyright, trademark, and other laws of both Turkey and foreign countries.

Materials provided during coaching sessions, including frameworks, templates, and methodologies, are the intellectual property of TurkCoach unless explicitly stated otherwise. Clients may use these materials for their business purposes but may not reproduce, distribute, or sell these materials without written permission.

5. User Responsibilities

Users of our Service agree to:

• Provide accurate and complete information when registering for events or contacting us
• Maintain the security of any account information
• Promptly notify us of any unauthorized access or security breaches
• Not use the Service for any illegal or unauthorized purpose
• Not attempt to probe, scan, or test the vulnerability of our systems

6. Payment Terms

Payment terms for coaching services are outlined in individual service agreements. Generally, we require a deposit before beginning work, with remaining payments made according to the payment schedule in the agreement.

For event registrations and other services purchased through our website, payment is required at the time of booking. All fees are non-refundable unless stated otherwise in the specific event description or service agreement.

7. Cancellation Policy

For coaching engagements, cancellation terms are outlined in individual service agreements. For events:

• Cancellations more than 14 days before the event: Full refund minus a 10% administrative fee
• Cancellations 7-14 days before the event: 50% refund
• Cancellations less than 7 days before the event: No refund

We reserve the right to cancel or reschedule events due to low enrollment, instructor illness, or other circumstances beyond our control. In such cases, registrants will receive a full refund or the option to transfer to another event.

8. Confidentiality

We maintain strict confidentiality regarding all client information. We will not disclose any proprietary information, business strategies, or other sensitive data shared during coaching engagements without explicit permission from the client.

Clients agree not to disclose our proprietary coaching methodologies, business strategies, or other intellectual property to third parties without our written consent.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. TurkCoach makes no warranties, whether express or implied, regarding the operation of the Service or the information, content, or materials included therein.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We make no warranty regarding the accuracy, reliability, or quality of the information obtained through the Service.

10. Limitation of Liability

In no event shall TurkCoach, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Implementation of business strategies or advice provided during coaching sessions

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
